These Terms & Conditions (“Terms”) govern your access to and use of the Diversey Clothiers website, products, order process, and related services.

In these Terms, “Diversey Clothiers,” “we,” “us,” and “our” refer to Diversey Clothiers. “You” and “your” refer to the person accessing our website, submitting information, or purchasing our products.

By accessing our website, submitting a Fit Profile, or placing an order, you agree to these Terms, our Privacy Policy, our Shipping & Production Policy, and our Fit, Alterations & Returns Policy.

Please review these documents carefully before placing an order. If you do not agree to these Terms, do not use our website or purchase our products.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to place an order with Diversey Clothiers.

By placing an order, you represent that:

You are legally able to enter into a binding agreement
The information you provide is accurate and complete
You are authorized to use the selected payment method
You are purchasing products for lawful personal or business use

Made-to-Measure Products

Diversey Clothiers provides made-to-measure clothing prepared using customer-submitted measurements, photographs, fit preferences, garment information, and selected details.

Our suits are not selected from standard-size, pre-made inventory. Once an order is reviewed, accepted, and finalized, the selected fabric may be cut and production may begin.

Because each garment is made for an individual customer, the order, change, cancellation, return, and fit policies applicable to made-to-measure products differ from those applicable to standard off-the-rack clothing.

Fit Profile and Customer Information

To prepare a made-to-measure garment, we may require you to provide information including:

Body measurements
Height and weight
Full-body photographs
Fit and style preferences
Information about your body shape or how clothing typically fits
Measurements and photographs of an existing garment
Contact, shipping, and order information

Your Fit Profile currently requests measurements, fit preferences, body information, and full-body photographs to support the order-review process.

You are responsible for following the measurement instructions and submitting information that is accurate, complete, and current.

You must not intentionally alter your posture, flex, hold in your stomach, change the placement of the measuring tape, or otherwise provide information that does not accurately represent your body or intended fit.

We may contact you if any measurement, photograph, or preference appears incomplete or inconsistent. You agree to respond accurately and within a reasonable period of time. Failure to respond may delay the finalization or production of your order.

Our review is intended to identify potential inconsistencies but does not guarantee that every measurement error or fit concern will be identified before production.

Photographs and Submitted Materials

You represent that you have the right to submit any photographs, measurements, descriptions, or other materials provided to Diversey Clothiers.

You authorize us and our service, tailoring, production, and quality-control partners to access and use those materials as reasonably necessary to:

Review and fulfill your order
Develop garment specifications
Communicate about measurements or fit
Produce and inspect the garment
Address customer-service or fit concerns
Maintain order and fit records as described in our Privacy Policy

Submitting Fit Profile photographs does not give Diversey Clothiers permission to use those photographs publicly for advertising, social media, testimonials, or other marketing. Separate permission will be obtained before any such public use.

Our collection and use of personal information are further described in our Privacy Policy.

Fit Preferences and Expectations

Made-to-measure clothing is intended to provide a more personalized fit than standard off-the-rack sizing. It does not guarantee that a garment will require no adjustment or that it will match every subjective fit preference without alteration.

Final fit may be affected by factors including:

Accuracy and placement of measurements
Body shape and posture
Changes in weight or body composition
Fabric characteristics
The customer’s selected fit preference
The fit and condition of any reference garment
Personal preferences concerning ease, length, taper, and movement
Normal tolerances associated with garment construction

Minor local alterations may sometimes be needed to achieve your preferred final fit.

Significant fit concerns must be reported and will be reviewed under our Fit, Alterations & Returns Policy.

Reference Garments

Measurements from an existing jacket or pair of trousers may be used as an additional fit reference.

You acknowledge that:

Reference-garment measurements supplement rather than replace body measurements
A garment may fit differently because of its fabric, construction, pattern, age, or condition
We may adjust or decline to copy a reference measurement when it conflicts with other information
Submitting a reference garment that fits poorly may affect the usefulness of its measurements

You should accurately describe what you like and dislike about the fit of any garment used as a reference.

Product Information and Appearance

We make reasonable efforts to describe and display our products accurately.

However:

Screen settings and lighting may affect how colors appear
Fabric color, texture, weave, and appearance may vary slightly from digital images
Natural or production-related variation may occur between fabric lots
Minor details may appear differently depending on garment size, proportions, and construction
Photographs are illustrative and may not show the exact appearance of every completed garment

These normal variations do not necessarily mean that a product is defective or incorrect.

If an item differs materially from the confirmed order, contact us in accordance with our Fit, Alterations & Returns Policy.

Pricing and Availability

Prices are displayed in U.S. dollars unless otherwise stated.

Applicable taxes, shipping charges, or other fees will be shown before the order is submitted when required.

We may change prices, product offerings, fabrics, colors, features, or availability at any time before an order is accepted. Changes will not affect an order that has already been accepted and finalized unless agreed to by the customer or otherwise permitted by law.

We reserve the right to correct typographical, technical, or pricing errors.

If a material pricing or product error affects an order, we may contact you for approval of the corrected information or cancel the affected order and refund the amount paid.

Placing and Accepting an Order

Submitting an order does not automatically mean that the order has been accepted for production.

After submission, we may:

Review your Fit Profile and selected details
Request corrected or additional information
Confirm availability
Verify payment
Decline an order that we cannot reasonably fulfill
Cancel an order involving suspected fraud, misuse, or material errors

An automated receipt or acknowledgement confirms that we received your submission. It does not necessarily confirm that the order has been finalized or accepted for production.

An order is accepted when Diversey Clothiers confirms that the order has been finalized for production or otherwise communicates acceptance.

Order Finalization

An order is generally considered ready for finalization after:

The required Fit Profile information has been submitted
Payment has been received or authorized
We have completed our initial order review
Any questions or inconsistencies have been resolved
The selected product and fabric are available

Production and delivery estimates begin after order finalization unless otherwise stated.

Payment

You agree to pay all charges associated with your order, including applicable taxes, shipping charges, and disclosed fees.

Payments may be processed by a third-party payment provider. By submitting payment information, you authorize the applicable payment provider and Diversey Clothiers to process the transaction.

We do not guarantee that every payment method will remain available. An order may be delayed or cancelled if payment cannot be authorized, verified, or completed.

Order Changes and Cancellations

Changes or cancellations may be possible before the order is finalized and production begins. Once fabric has been cut, materials have been committed, or production has started, changes and cancellations may no longer be possible.

Approved changes may affect the price and estimated completion date.

Any approved cancellation, refund, or other resolution will depend on the status of the order, costs already incurred, and applicable law.

Production and Delivery Estimates

Most orders are expected to arrive within approximately 3–4 weeks after order finalization, unless another timeline is provided.

Production and delivery dates are estimates rather than guaranteed arrival dates. Timing may be affected by:

Delayed customer responses
Measurement clarification
Fabric availability
Production volume
Quality-control review
Carrier delays
Weather
Customs or transportation disruptions
Events outside our reasonable control

If we are unable to ship within the stated timeframe, we will communicate available options as required by applicable law. Depending on the circumstances, those options may include agreeing to a revised timeframe or cancelling the affected order for a refund.

Shipping Information

You are responsible for providing an accurate and complete shipping address.

Contact us promptly if you discover an error. We may be able to update the address before shipment, but changes cannot be guaranteed after the package has been transferred to the carrier.

Tracking information will be sent when available. Tracking estimates are provided by the carrier and are not guaranteed by Diversey Clothiers.

If a package is delayed, lost, damaged, refused, or returned to sender, contact us so we can review the circumstances and determine the appropriate next step.

Inspection After Delivery

You should inspect and try on your suit promptly after delivery.

Fit concerns, damage, incorrect items, workmanship concerns, or material differences from the confirmed order must be reported within 14 days of delivery.

Do not wear the suit beyond the initial fitting or have it altered before contacting us about a significant concern. Alterations or extended wear may limit our ability to inspect the original condition of the garment or provide assistance.

Alterations

Routine alteration services and costs are not included with your purchase unless otherwise expressly stated in writing.

Customers are responsible for arranging and paying for routine alterations performed by a third-party tailor.

If you believe your suit has a significant fit issue, workmanship concern, or differs materially from the confirmed order, contact us within 14 days of delivery and before having alterations performed.

Diversey Clothiers is not responsible for third-party alteration work or costs unless agreed to in writing in advance.

Returns, Refunds, and Exchanges

Because each suit is made specifically for the customer’s submitted measurements, fit preferences, and selected details, we do not offer standard returns, refunds, or size exchanges.

A difference between the finished garment and a customer’s subjective fit preference does not automatically qualify an order for a return, refund, replacement, or remake.

We will review timely concerns involving:

Significant fit issues
Manufacturing or workmanship concerns
Damage discovered upon delivery
Incorrect items or selected details
Garments that differ materially from the confirmed order

Any assistance or resolution will be determined after reviewing the individual circumstances.

Nothing in these Terms limits any rights or remedies that cannot lawfully be limited under applicable law.

Promotions and Discounts

Promotional offers, credits, and discount codes may be subject to separate conditions, eligibility requirements, expiration dates, and product exclusions.

Unless otherwise stated:

Promotions cannot be combined
Discounts have no cash value
Promotions cannot be applied retroactively
Promotions may not be transferred or resold
Only one promotion may be used per order

We may modify or end a promotion before an eligible order is placed, subject to applicable law.

Weddings and Group Orders

Wedding and group orders may involve separate timelines, pricing, communications, and coordination requirements.

Each participant may be required to complete an individual Fit Profile and submit payment separately unless another arrangement is confirmed in writing.

The individual coordinating a group order is not authorized to approve another participant’s measurements, fit preferences, or order changes unless expressly authorized.

Event dates should be communicated accurately. We do not guarantee delivery by an event date unless that commitment is expressly confirmed in writing.

Electronic Communications

By providing your email address, phone number, or preferred contact method, you consent to receive communications reasonably related to:

Your Fit Profile
Measurement questions
Payment
Order review
Production
Shipping and tracking
Customer service
Fit or order concerns
Policy or service notices

Transactional communications are separate from marketing communications and may continue even when you opt out of promotional messages.

Marketing emails or text messages will be sent only as permitted by law and subject to any applicable consent and opt-out requirements.

Acceptable Use of the Website

You may use our website only for lawful purposes.

You may not:

Attempt to gain unauthorized access to the website or related systems
Interfere with website security or operation
Introduce viruses, malware, or harmful code
Use automated systems to scrape, copy, or collect website content without permission
Submit false, fraudulent, misleading, or unlawful information
Impersonate another person
Use the website to violate another person’s rights
Attempt to place a fraudulent order
Copy or exploit our website content for unauthorized commercial purposes

We may restrict or terminate access when we reasonably believe the website is being misused.

Intellectual Property

The Diversey Clothiers name, branding, logos, website design, photographs, graphics, text, measurement instructions, fit materials, product descriptions, and other original content are owned by or licensed to Diversey Clothiers and are protected by applicable intellectual-property laws.

You may view and use the website for personal, noncommercial purposes.

You may not reproduce, modify, distribute, publish, sell, license, create derivative works from, or commercially exploit our content without prior written permission.

Feedback

You may voluntarily provide suggestions, reviews, comments, or other feedback about our products and services.

We may use general suggestions and feedback to improve our business without payment or obligation to you. This section does not authorize us to publicly use your name, photographs, testimonial, or likeness without any permission required by law.

Third-Party Services and Links

Our website may use or link to third-party services, including payment processors, form providers, shipping carriers, analytics services, and other websites.

We do not control and are not responsible for the content, availability, security, or practices of independent third parties. Your use of a third-party service may be governed by that provider’s separate terms and privacy policy.

Website Availability

We may update, suspend, restrict, or discontinue parts of the website at any time.

We do not guarantee that the website will always be uninterrupted, error-free, secure, or compatible with every device or browser.

Website interruptions do not change obligations relating to orders already accepted, except where performance is prevented or delayed by circumstances outside our reasonable control.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and its informational content are provided on an “as available” basis.

We do not guarantee that website descriptions, guides, measurement illustrations, or educational content will address every body shape, fit preference, or circumstance.

This section does not exclude any express commitment stated in a confirmed order or any warranty, right, or remedy that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, Diversey Clothiers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the website or purchase of a product.

To the fullest extent permitted by law, our total liability relating to a particular order will not exceed the amount paid to Diversey Clothiers for the affected order.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including any liability arising from fraud, willful misconduct, or other conduct for which limitation is prohibited by law.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, labor disruptions, transportation interruptions, customs delays, carrier failures, government action, public-health emergencies, power or technology failures, civil unrest, or disruptions affecting suppliers and production partners.

This section does not eliminate any cancellation, refund, notice, or other rights available under applicable law.

Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Subject to any rights you may have under applicable consumer law, disputes relating to these Terms or our services will be brought in the state or federal courts located in Cook County, Illinois.

Nothing in this section deprives a consumer of protections that cannot lawfully be waived under the laws of the jurisdiction where the consumer resides.

Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted or removed as necessary.

The remaining provisions will continue in effect.

No Waiver

A delay or failure by Diversey Clothiers to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written permission.

We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or other lawful business transaction.

Entire Agreement

These Terms, together with the confirmed order details and the policies incorporated into them, constitute the agreement between you and Diversey Clothiers concerning your use of the website and purchase.

If a confirmed order term expressly conflicts with these general Terms, the specifically confirmed order term will control for that order.

Changes to These Terms

We may update these Terms periodically to reflect changes to our products, services, business practices, or legal obligations.

The updated version will be posted with a revised effective date. Changes will apply prospectively unless otherwise stated or required by law.

The Terms in effect when an order is accepted will generally govern that order.
